NUR Platform Terms of Use and Informed Consent

Introduction and Acceptance

This Terms of Use and Informed Consent Agreement ("Agreement") is entered into between you ("User") and Amplifai Health ("Amplifai Health", "we", "us", "our"). By creating an account, activating the NUR Platform, or accessing any NUR product, you agree to be bound by this Agreement.

Your club or organisation has entered into a separate Master Services Agreement with Amplifai Health. That agreement governs the relationship between Amplifai Health and your organisation. This Agreement governs your individual use of the platform and is personal to you.

Acceptance of this Agreement is recorded with an exact timestamp and version identifier at the time you agree. Continued use of the platform following any update to this Agreement constitutes ongoing acceptance of the then-current version.

Nature of Service and Medical Disclaimer

The NUR Platform is a wellness monitoring and athletic performance support tool. It is not a medical device, clinical diagnostic system, or healthcare service. COMPASS zone assignments and readiness scores are decision-support outputs intended for use by qualified coaches and clinical practitioners, they do not constitute medical diagnoses, clinical opinions, or prescriptions.

AI-generated coaching recommendations produced by NURAI are informational in nature and do not substitute for the professional judgement of a qualified physiotherapist, sports scientist, or medical practitioner. You should always consult a qualified healthcare professional before making health-related decisions.

The NUR Platform has not been evaluated or approved by the FDA, Health Canada, the Saudi Food and Drug Authority (SFDA), or any other regulatory authority as a medical device.

Platform Products Covered

This Agreement governs your use of all NUR Platform products:

• My NUR — the athlete-facing mobile application for receiving daily COMPASS assessments, scan results, and personal health insights.
• NUR Scanner — the thermal imaging device and its associated capture and processing software.
• NUR HUB — the coach and clinical staff management dashboard for team-level health monitoring, alerts, and Return-to-Play workflows.

Access to specific products and features is determined by the role assigned to your account by your organisation administrator. Not all users have access to all features.

Account Eligibility and Minors

To create an account independently, you must be at least 18 years of age. Users aged 13–17 may access the platform only where verified parental or guardian consent has been obtained and recorded by the club or organisation administrator before account activation. The organisation administrator is solely responsible for ensuring this consent is obtained, documented, and retained.

Users under 13 years of age are not permitted on the platform under any circumstances. Club and organisation administrators warrant their compliance with this requirement.

Saudi Arabia note: The applicable minor consent threshold under the Personal Data Protection Law (PDPL) is conservatively treated as 18 years of age, pending confirmation by Saudi legal counsel. Parental consent is required for all users under 18 in Saudi-deployed instances.

User Responsibilities and Acceptable Use

You are responsible for:

1. Providing accurate and complete information in your health questionnaire, demographic profile, and body map submissions;
2. Safeguarding your account credentials and not sharing them with any other person;
3. Not sharing, transferring, or assigning your Session ID or QR code to any other person, as these uniquely link your health data to a physical device instance;
4. Complying with all scanning environment requirements, including use of a designated private enclosed room, the mandatory acclimatisation period indicated by the application, and the clothing protocol specified for thermal accuracy;
5. Reporting any known inaccuracies in your health data to your clinical team promptly.

Failure to follow these requirements may affect the accuracy of your results and constitutes a breach of this Agreement.

Third-Party Wearable Services

Wearable integration is entirely optional. If you choose to connect a compatible wearable device, data will flow through authorised third-party API services to the NUR Platform. Amplifai Health is not responsible for the accuracy, completeness, or availability of data provided by wearable devices or their associated third-party services.

Interruptions, errors, or discontinuations of third-party wearable services may affect the availability of integrated data within NUR. Amplifai Health reserves the right to modify or discontinue specific wearable integrations if required by changes to third-party services. You may disconnect your wearable integration at any time via the application settings.

Consent Versioning and Re-Acceptance

Your acceptance of this Agreement is recorded with an exact timestamp and the version identifier of the documents you accepted. Continued use of the platform following any update to this Agreement or the Privacy Statement constitutes acceptance of the then-current version.

Your prior consent records are permanently preserved as an immutable audit trail. You may request a record of your consent history at any time by contacting our privacy team at support@amplifaihealth.com.

Limitation of Liability

To the maximum extent permitted by applicable law, Amplifai Health shall not be liable for:

• Any physical injury, loss, or harm arising from use or misuse of the NUR Platform;
• Any failure to highlight an underlying medical condition, injury, or health risk;
• Reliance on COMPASS scores, zone assignments, or AI-generated coaching recommendations without appropriate clinical oversight;
• Inaccuracies, interruptions, or failures in third-party wearable devices, platforms, or integrations; or
• Any indirect, incidental, special, or consequential damages arising from use of the platform.

No action should be taken based solely on platform outputs without independent professional evaluation.

Your use of the NUR Platform is at your own risk, subject to compliance with the scanning protocols and operational requirements provided in the application.

Intellectual Property

The NUR Platform, COMPASS scoring methodology, NURAI algorithm, all software components, and all associated outputs are proprietary to Amplifai Health and protected by applicable intellectual property laws. By using the platform, you are granted a limited, non-exclusive, non-transferable licence to access and use the platform for the purposes described in this Agreement.

You receive no licence to the underlying models, algorithms, source code, or any other proprietary components beyond your personal use of the platform. You may not reverse engineer, decompile, copy, distribute, or create derivative works from any part of the NUR Platform.

Governing Law and Dispute Resolution

This Agreement is governed by the laws of the Kingdom of Saudi Arabia for users accessing the platform through Saudi-based deployments. Users in Canada are subject to the applicable laws of their province or territory. Users in the United States are subject to the applicable laws of their state.

In the event of a dispute, the parties agree to first attempt resolution in good faith through direct negotiation. If negotiation is unsuccessful within 30 days, the dispute shall be referred to binding arbitration under the applicable rules of the jurisdiction.

US users: To the extent permitted by applicable law, you waive the right to participate in any class action proceeding against Amplifai Health.

Modifications to Terms

Amplifai Health may update this Agreement from time to time. Material changes — those that affect your rights, obligations, or how your data is used — will be notified to you by email to your registered address. Continued use of the platform following the effective date constitutes acceptance of the updated Agreement.

Non-material changes (such as contact detail updates or clarifications that do not alter your rights) will be published with at least 14 days' notice. The effective date on this Agreement will be updated with each revision. Continued use of the platform after the notice period constitutes your acceptance of the updated Agreement.

Informed Consent to Thermal Scanning and Biometric Data Processing

By using the NUR Scanner, you explicitly consent to the following:

• Thermal Image Capture: The NUR Scanner captures thermal infrared images of your body for the purpose of detecting asymmetric patterns of temperature variations.
• Standard Visual Image Capture: A standard visible-spectrum image is captured solely to perform body-contour mapping and ensure thermal data is correctly aligned with your anatomy. This image is automatically and permanently purged upon completion of the analysis. It is never stored in your account, is not accessible to Amplifai Health staff after the session ends, and cannot be retrieved once the session is complete.
• Biometric Data Processing: The thermal asymmetry patterns derived from your scan constitute biometric data. You acknowledge that this data is processed as described in the NUR Privacy Statement and may be subject to specific biometric data laws in your jurisdiction.

You have the right to withdraw this consent at any time. Withdrawal of consent to thermal scanning will prevent you from using the NUR Scanner and will result in the platform operating without thermal data, which will affect the completeness of your COMPASS assessment.

COMPASS Score and AI Algorithmic Disclosure

The COMPASS score is computed by NURAI, an AI-powered algorithm that combines your wearable-derived Systemic Readiness score and your Thermal Asymmetry Index into a single readiness score between 0 and 100 and a zone assignment (Safe, Recovery, Deceptive Readiness, or Danger).

You acknowledge and agree that:

1. The exact version of each AI component used to produce your assessment is stored alongside your result, enabling full reproducibility;
2. You may request an explanation of how a specific score was derived by contacting your clinical team or Amplifai Health's support team;
3. The COMPASS score is a decision-support input for your coaching and medical staff, it is not a final clinical decision and does not replace professional medical assessment;
4. No solely automated decision with legal or clinically significant effect is made by the platform. All COMPASS outputs are reviewed by qualified staff before any training or clinical action is taken.

The COMPASS score should not be used as the sole basis for any health, training, or clinical decision.

Wearable Data Consent

Wearable integration is optional. If you choose to enable it, you consent to Amplifai Health retrieving the following wellness data through authorised third-party wearable platforms, subject to the permissions you grant to your wearable provider:

• Heart rate and heart rate variability (HRV)
• Sleep quality and duration metrics
• Activity and exercise data
• Training load and acute:chronic workload ratio (ACWR)
• Recovery or stress indicators

This data is used solely to compute your Systemic Readiness score and enhance your COMPASS assessment. It is never used for advertising, marketing profiling, or resale. You may revoke wearable integration at any time via the app settings. Revocation stops future data pulls but does not automatically delete previously retrieved wearable metrics — contact contact@amplifaihealth.com to request deletion of historical wearable data.

Return-to-Play (RTP) Monitoring Consent

When your clinical team records an injury event in NUR HUB, the platform activates Return-to-Play (RTP) monitoring mode for your account. By continuing to use the platform following injury recording, you consent to:

1. Phase-Gated Rehabilitation Monitoring: Your thermal scan data is used to observe recovery trends across four rehabilitation phases: Acute, Rehabilitation, Progressive Loading, and Return to Competition;
2. Pre-Injury Baseline Lock: Your thermal baseline established before the injury is locked as the reference benchmark to support practitioner assessment of progression;
3. Contralateral Limb Surveillance: Both sides of your body are monitored throughout rehabilitation to highlight variations in compensatory stress on the uninjured limb;
4. Clinical Team Data Access: Your physiotherapist and assigned clinical staff have access to your full thermal trajectory data, COMPASS history, and RTP phase status.

You acknowledge that RTP clearance requires two consecutive qualifying scans confirming thermal asymmetry within your individual baseline, and that the clearance decision is made by your physiotherapist, not the platform. NURAI's RTP timeline projections are planning estimates only and do not constitute clinical clearance.

Notification and Alert Consent

By using the My NUR application, you consent to receiving push notifications for:

• Scan results and your daily COMPASS zone assignment;
• Zone changes, particularly transitions into the Deceptive Readiness or Danger zones;
• RTP phase progression updates and clearance milestones;
• Reminders to complete scheduled scans.

You may manage your notification preferences in the application settings. Certain clinical alert notifications — specifically Danger Zone assignments and Deceptive Readiness warnings during active RTP monitoring — may be non-optional to ensure clinical safety. Disabling all notifications is not available during an active RTP workflow.

Data Access Rights and Role-Based Permissions

As a coach, physiotherapist, sports scientist, or other member of the clinical or coaching staff, you are granted access to athlete health data solely in your professional capacity as assigned by your organisation administrator. Your access is strictly scoped to athletes within your organisation.

You may not:

• Share athlete health data with third parties not authorised by the organisation or Amplifai Health;
• Export or reproduce athlete health data outside the NUR Platform for purposes other than athlete health management;
• Use athlete data for personal, commercial, or research purposes without express written consent from both the athlete and Amplifai Health; or
• Access data belonging to athletes outside your assigned organisation.

Any breach of these obligations may result in immediate termination of your access and may be reported to your organisation and relevant regulatory authorities.

Clinical Notes and Audit Trail Obligations

Clinical notes entered through NUR HUB are append-only and permanently immutable. Once submitted, a clinical note cannot be edited or deleted. You are solely responsible for the accuracy, completeness, and clinical appropriateness of any note you submit.

All clinical note activity is logged with a precise timestamp and attributed to your authenticated user account, creating a permanent, auditable chain of custody. If you identify an error in a submitted note, you must submit a corrective or supplementary note — the original entry will be preserved. This immutability cannot be overridden by any configuration or administrative action.

RTP Workflow Authority and Clearance Responsibility

The Return-to-Play workflow is initiated, managed, and closed exclusively by authorised clinical staff. The decision to progress an athlete between rehabilitation phases, and the final clearance decision — including manual clinical override — is the professional responsibility of the designated clinical lead.

COMPASS data, thermal trajectory information, and NURAI's RTP projections are decision-support tools; they do not make clearance decisions autonomously. The physiotherapist bears professional responsibility for all RTP clearance decisions, including decisions that deviate from or override the platform's data-driven recommendations.

Manual override of conditions-based clearance criteria is logged and attributed to the approving clinician. This record is permanent and cannot be removed.

Alert Management Obligations

When you receive a clinical alert through NUR HUB — including Danger Zone assignments, Deceptive Readiness warnings, contralateral limb stress alerts, and RTP milestone notifications — you have a professional obligation to review and respond to the alert in accordance with the clinical response protocols established by your organisation.

Alert records are logged with severity classification, generation timestamp, and the user account to which they were delivered. Failure to act on a clinical alert does not affect the logging record and may be visible to your organisation administrator.
